Streamlining Crypto ETF Approvals

Under the newly adopted Rule 6c-11, the SEC's decision allows for the listing of commodity-based trust shares, which include certain crypto ETFs, based on a standardized set of requirements rather than bespoke approvals. SEC Chairman Paul Atkins highlighted that these generic standards are designed to ensure capital markets remain at the forefront of digital asset innovation, maximize investor choice, and reduce barriers to accessing digital asset products within trusted U.S. markets. This development comes as numerous spot ETF applications for cryptocurrencies like Solana, XRP, Litecoin, Dogecoin, Avalanche, Chainlink, Polkadot, and BNB await the SEC's judgment, potentially seeing expedited reviews.

New Eligibility Standards and Investor Concerns

For a spot crypto ETF to qualify under these generic standards, it must either hold a commodity traded on an Intermarket Surveillance Group market with surveillance access, or one that underpins a futures contract listed on a designated contract market for at least six months with a surveillance sharing agreement. Alternatively, it can be eligible if it's already tracked by an ETF with at least 40% exposure listed on a national securities exchange. Any product not meeting these specific criteria would still require an individual rule proposal from the exchange to the SEC. However, not all commissioners view this acceleration without apprehension. Commissioner Caroline Crenshaw voiced strong concerns, warning that the new standards might lead to a market saturated with products that haven't undergone thorough scrutiny for investor protection, suggesting the Commission might be sidestepping its review responsibilities in favor of speed.
